Public Hearing and Extension of Time for

Comment Period - Devils Lake, North Dakota

In response to requests for a public hearing, the U.S. Army Corps of Engineers, St. Paul District, will hold a formal public hearing on the Devils Lake Outlet Study (Final Integrated Planning Report/Environmental Impact Statement). That Report/EIS may be obtained by calling Mr. Dave Loss at 651-290-5435 or Mr. Robert Anfang at 651-290-5268. The hearing will be held on Monday, June 9, 2003, in Fargo, North Dakota, at the Holiday Inn (I-29 and 13th Avenue South). The doors will open at 3 p.m. for informal discussions with Corps of Engineers representatives. The hearing will begin at 4:00 p.m. and conclude at 7:00 p.m.. This hearing is being held under the authority of ¤404 of the Clean Water Act.

The primary purpose of the hearing is to gather additional information from the public or interested federal and state agencies regarding the Section 404(b)(1) evaluation contained in the Final Integrated Planning Report/Environmental Impact Statement released in April 2003. However, any comments received on other aspects of the Report/EIS will also be considered. The Corps will give no formal presentation on the Outlet Study during the hearing. No responses to statements or comments will be provided by the Corps during the hearing.

Any person or organization may present an oral statement, a written comment or recommendation, or both during the hearing. That statement may be provided personally or through an attorney or other representative.

Each person or organization making an oral presentation will be allowed 5 minutes to complete that presentation. While cross examination of presenters is not allowed, the Corps will provide an opportunity for oral or written rebuttal of statements made at the hearing. Oral rebuttals are limited to 2 minutes each.

The hearing will be recorded by a court reporter and a verbatim transcript will be made available for review after the hearing. Written comments, statements, rebuttals or recommendations may also be provided to the Corps during the hearing. Additionally, written comments or rebuttals may be submitted to the Corps through June 19, 2003. Comments not presented at the hearing should be submitted to the St. Paul District, U.S. Army Corps of Engineers, ATTN: CEMVP-PM-A, 190 Fifth Street East, St. Paul, MN 55101-1638. The verbatim transcript of the hearing and any written comments, statements, rebuttals or recommendations will be provided to the Chief of Engineers for his consideration in making any decisions or recommendations regarding the proposed Devils Lake outlet.

The formal comment period on the Devils Lake Final Integrated Planning Report and Environmental Impact Statement is also extended from May 19, 2003, to June 19, 2003. Comments on the Report should be submitted to Headquarters, U.S. Army Corps of Engineers, ATTN: CECW-P (IP), 7701 Telegraph Road, Alexandria, VA 22315-3860.
